These Terms and Conditions of Sale (hereinafter the “Terms”) govern the conditions applicable to any online sale of fashion creations and items offered under the brand “Clara Daguin” (hereinafter the “Products”), made on the official website www.claradaguin.com (hereinafter the “Site”).

Online sales of Products through the Site are carried out, under the terms set out in these Terms, directly by CLARA DAGUIN, a Société par Actions Simplifiée (Simplified Joint Stock Company) with a share capital of €1,000.00, registered with the Paris Trade and Companies Register under number 662 042 449, with its registered office at 134-140 rue d'Aubervilliers, 75019 Paris, France (hereinafter the “Seller”).

These Terms may be amended at any time. The applicable Terms are those in effect at the time the order is placed.

1. SELLER’S COMMERCIAL POLICY

​

The Products are intended exclusively for private individuals, natural persons of legal age with legal capacity, acting for personal purposes (hereinafter the “Buyers”). Any order placed for resale purposes is strictly prohibited.

The Seller reserves the right to refuse any order that does not comply with these Terms or any abnormal order (e.g., unusually large quantities of Products or suspected fraudulent behavior).

The Buyer must unconditionally accept these Terms, the Legal Notice, and the Privacy Policy in order to place an order.

2. ORDER

​

The ordering process is clearly described on the Site. Buyers may place orders with or without creating an account. An order summary is provided before final confirmation.

The sales contract is deemed concluded when the Buyer receives an email confirming the order (hereinafter the “Order Confirmation”). The Seller may refuse an order for legitimate reasons (e.g., product unavailability, obvious error, payment issue, etc.).

3. PRODUCT DESCRIPTION AND PRICES

​

The Products offered for sale are described and presented as accurately as possible. They may be unique pieces or limited editions.

Prices are listed in euros, inclusive of all taxes (TTC), excluding delivery charges. The Seller reserves the right to change prices at any time, without affecting orders that have already been confirmed.

4. PAYMENT

​

Payment is made by credit card, bank transfer, or any other method indicated on the Site. Payments are secure.

The Buyer’s payment method will only be charged upon shipment of the order, after the Order Confirmation. If payment fails, the order will be canceled.

5. SHIPPING AND DELIVERY

​

Products are delivered to the address provided by the Buyer, within the timeframes specified when the order is placed. A tracking number will be sent to the Buyer.

Ownership and risk transfer to the Buyer upon delivery. The Buyer must inspect the package upon delivery and report any issues to the carrier and then to the Seller.

6. RIGHT OF WITHDRAWAL

​

In accordance with the law, the Buyer has 14 days to exercise their right of withdrawal. Customized or made-to-order Products (such as bespoke or couture pieces) are excluded from this right.

Returned items must be unworn, in their original condition, and in their original packaging. Returns are at the Buyer’s expense using a carrier of their choice.

7. REFUNDS

​

Once the returned Products have been received and inspected, a refund will be issued within 14 days. Refunds will be processed using the same payment method used for the original purchase.

8. WARRANTIES

​

Products are covered by the legal guarantee of conformity and the guarantee against hidden defects. In the event of a defect or non-conformity, the Buyer may request repair, replacement, or reimbursement, under the conditions provided by law.

9. PERSONAL DATA

​

Personal data collected is processed in accordance with the Privacy Policy available on the Site.

​

10. FORCE MAJEURE

​

The Seller shall not be held liable for the non-performance of any obligation in the event of force majeure, as defined by French law.

11. LIABILITY

​

The Seller shall not be held liable for any misuse of the Products or for uses not in accordance with their intended purpose. Product images are for illustrative purposes only and are not contractually binding.

12. MISCELLANEOUS

​

If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect. The failure of the Seller to enforce any provision at a given time shall not be construed as a waiver of such provision.

13. APPLICABLE LAW – DISPUTE RESOLUTION

​

These Terms are governed by French law. In the event of a dispute, the Buyer is encouraged to first contact Customer Service for an amicable resolution. If no resolution is reached, the Buyer may refer the matter to a mediator or use the European Commission’s online dispute resolution platform: http://ec.europa.eu/odr.
