TERMS & CONDITIONS
These Terms and Conditions of Sale (hereinafter the “Terms”) govern all online sales of fashion creations and items offered under the brand CLARA DAGUIN (hereinafter the “Products”) on the website www.claradaguin.com (hereinafter the “Site”).
Online sales are carried out by CLARA DAGUIN, a Société par Actions Simplifiée with a share capital of €1,000, registered with the Paris Trade and Companies Register under number 662 042 449, with its registered office at 134–140 rue d’Aubervilliers, 75019 Paris, France (hereinafter the “Seller”).
The applicable Terms are those in effect at the time the order is placed. The Seller may update these Terms at any time.

1. SELLER’S COMMERCIAL POLICY
The Products are intended exclusively for private individuals acting for personal purposes (hereinafter the “Buyer”). Any purchase made for resale or commercial purposes is strictly prohibited.
The Seller reserves the right to refuse any order that appears abnormal (e.g., unusually large quantities, suspected fraud) or that does not comply with these Terms.
To place an order, the Buyer must accept these Terms, the Legal Notice, and the Privacy Policy.

2. ORDER
The ordering process is described on the Site. Orders may be placed with or without creating an account. A summary is provided before final confirmation.
The sales contract is formed when the Buyer receives the Order Confirmation email. The Seller may refuse an order for legitimate reasons, including product unavailability, payment issues, or obvious errors.

3. PRODUCT DESCRIPTION AND PRICES
Products are described and presented as accurately as possible. Some items may be unique pieces or limited editions.
Prices are listed in euros (€) by default, all taxes included (TTC), excluding delivery fees. The Seller may modify prices at any time, but confirmed orders will not be affected.

3.1. Currency Selection
Prices may be displayed in different currencies depending on the Buyer’s location or the currency selected on the Site. The final amount charged will be processed in the currency chosen at checkout. Any conversion fees applied by the Buyer’s bank or payment provider remain the Buyer’s responsibility.

4. PAYMENT
Payment may be made by credit card, bank transfer, or any method indicated on the Site. Payments are secure.
The Buyer’s payment method is charged upon shipment of the order. If payment fails, the order will be canceled.

5. SHIPPING AND DELIVERY
Products are delivered to the address provided by the Buyer. Estimated delivery times are indicated during checkout. A tracking number will be provided once the order is shipped.
Risk and ownership transfer to the Buyer upon delivery. The Buyer must inspect the package upon receipt and notify the carrier and the Seller of any issues.

6. RIGHT OF WITHDRAWAL
In accordance with applicable law, the Buyer has 14 days from receipt of the order to exercise their right of withdrawal.
The right of withdrawal does not apply to:
customized items
made‑to‑order pieces
bespoke or couture creations
Returned items must be unworn, unused, and in their original packaging with all accessories and documents.
Returns are at the Buyer’s expense.

7. REFUNDS
Refunds are issued within 14 days after the Seller receives and inspects the returned Products. Refunds are made using the same payment method used for the original purchase.
8. WARRANTIES
Products are covered by:
the legal guarantee of conformity
the guarantee against hidden defects
In case of non‑conformity or defect, the Buyer may request repair, replacement, or reimbursement under the conditions provided by law.

9. PERSONAL DATA
Personal data collected during the order process is processed in accordance with the Privacy Policy available on the Site.

10. FORCE MAJEURE
The Seller shall not be held liable for failure to perform its obligations in the event of force majeure, as defined by French law.

11. LIABILITY
The Seller shall not be held liable for misuse of the Products or use contrary to their intended purpose. Product images are provided for illustrative purposes and may differ slightly from the final Product.

12. MISCELLANEOUS
If any provision of these Terms is deemed invalid, the remaining provisions shall remain in full force. Failure by the Seller to enforce any provision shall not constitute a waiver.

13. APPLICABLE LAW – DISPUTE RESOLUTION
These Terms are governed by French law.
In case of a dispute, the Buyer is encouraged to contact Customer Service for an amicable resolution. If no agreement is reached, the Buyer may refer the matter to a mediator or use the European Commission’s online dispute resolution platform:
